DOWNTOWN LAURINBURG SOCIAL DISTRICT OPERATIONS AND MAINTENANCE PLAN

City of Laurinburg Ordinance Adopted January 17, 2023

Introduction

North Carolina Session Law 2021-150 allows local governments to establish “Social Districts” within their jurisdictions. Social Districts are designated areas within a local government’s jurisdiction where businesses holding a valid permit issued by the North Carolina Alcoholic Beverage Control Commission (ABC) (e.g., bars, breweries, restaurants) may sell alcoholic beverages in designated containers to be consumed within a Social District.

The City of Laurinburg amended section 24-10 of Article I of Chapter of the Code of Ordinances for the City of Laurinburg allowing for the establishment of a Social District in Downtown Laurinburg.  This Management Plan outlines how the Downtown Laurinburg Social District will be managed and maintained.  For purposes of this Plan, “Social District” means the Downtown Laurinburg Social District.  This Plan will be submitted to the North Carolina ABC Commission and placed on the Downtown Laurinburg website.

Management & Enforcement

The Downtown Laurinburg Social District will be managed by the City of Laurinburg Downtown Development Department, the Police Department, and the Public Works Department.

Law enforcement within the Social District shall be provided by the City of Laurinburg Police Department.

City of Laurinburg Police Officers will enforce the requirements of the Social District.  The City of Laurinburg reserves the right to prohibit a permit holder from participating in the district due to violations of the Social District management plan.

The City’s Public Works Department provides sanitation services within the Social District boundaries, including trash removal and litter pick up. Trash/recycling receptacles are located within the boundaries of the Social District to encourage patrons to properly dispose of their used cups and unconsumed alcohol.

To report potential violations please call the Laurinburg Police Department at 910-276-3211 or the N.C. Alcohol Law Enforcement Division (1-877-ALE-AGENT).

Operations

The Social District will operate 7 days a week during the following days and times:

  • Monday through Thursday between the hours of 10:00 a.m. and 10:00 p.m.
  • Friday and Saturday between the hours of 10:00 a.m. and 11:00 p.m.
  • Sunday between the hours of 12:00 a.m. and 10:00 p.m.

District Designation and Logo

The Downtown Laurinburg Social District participation businesses must utilize a logo created by the City of Laurinburg – an illustration is depicted below.  Boundaries of the Social District will be clearly marked by the City with signs affixed to all entrances/exit points.

Beverage Containers and Rules of Use

A Permitee located in the Social District may sell open containers of alcoholic beverages for consumption within the Social District and allow Customers to exit its premises to the Social District in accordance with the following requirements:

  • The container is made of clear plastic.
  • The container displays, in no less than 12-point font, the statement, “Drink Responsibly – Be 21”.
  • The container will not hold more than 16 fluid ounces.
  • Alcoholic beverages may not be carried into any non-participating businesses within the Social District.
  • Upon leaving an establishment where an alcoholic beverage is purchased, the beverage must be consumed or discarded before entering a different business that serves alcohol.
  • Alcoholic beverages must be disposed of before exiting the social district unless the person is reentering the licensed premises where the alcoholic beverage was purchased.

Financing

The Downtown Laurinburg Social District will be marketed and promoted by the Downtown Advisory Committee, and the City of Laurinburg for signage, logo development, education and enforcement.  All other costs including containers for use will be funded by Permittees.

Participating Businesses

Businesses selling alcoholic beverages within the Social District must possess a valid ABC permit and register with the City of Laurinburg, acknowledging to abide by the rules and regulations of this Plan and the Downtown Laurinburg Social District Ordinance O-2023-01 that was adopted on January 17, 2023.

Businesses located within or contiguous to the Social District without an ABC permit may participate in the Social District by allowing people to enter their business with alcoholic beverages purchased in an approved container.  Participating businesses that are not selling alcoholic beverages are not required to register with the City.

The City and Downtown Advisory Committee, Inc. will provide information and materials to participating and nonparticipating businesses to ensure the understanding of their obligations under this Plan and the Downtown Laurinburg Social District Ordinance.

  • Participating businesses will be provided window clings with the Social District logo and “Beverages Welcome” to businesses upon request. Participating businesses shall display the decal at all times.
  • Businesses not wishing to participate in the District will be provided window clings indicating “Alcoholic Beverages Prohibited” upon request.

Exceptions

In any area where there is no overlap between the Social District and a permitted special event, alcohol obtained from a special event vendor may not be taken out of the special event area.  Alcohol obtained from a Social District Permittee within the special event area may not be taken out of the Social District and into the special event area if it does not overlap with the Laurinburg Downtown Social District.

Permitted special events may make a request to the City of Laurinburg Community Development Department for a temporary suspension of the Social District within the special event area for the duration of the special event.
